CONTRACT

The booking is accepted when Active Traveler Peru receives the first deposit from its clients. At this point in time the contract between client and Active Traveler Peru is effective and legally binding. 
In order to secure the trip, we will require a 30% deposit of the total package price by the time of your booking.

 

OUR SERVICE

Active Traveler Peru is a local tour operator based in Peru, which offers a booking, consulting and coordinating service by preparing tailor-made itineraries. We handle bookings and payments on your behalf with a selection of various independent suppliers, such as hotels, restaurants, airlines and other means of transportation, private guides and other services specified in the itinerary; that even though are not under our direct control, provide a high quality service.

 

TRAVEL INSURANCE

Active Traveler Peru, including their representatives, employees and agents will take no responsibility for any cost, losses incurred or suffered by the guest, or guests´ dependents or traveling companions, with regards to but not limited to, any of the eventualities mentioned above. Travelers will be charged directly by the relevant service providers for any emergency services they may require, for other services not covered by the insurance, traveler will be charged under the same procedure. We also advise travelers to visit their physicians to be up to date with vaccines and address any concerns regarding international traveling.

TRAVEL DOCCUMENTS

It is your responsibility to ensure you have a valid passport and meet all necessary entry requirements of our country. These vary by country and nationality and can change from time to time. Active Traveler Peru will do its best to inform you of these general requirements, but we ask that you contact the corresponding embassy/consulate in your country of residence, to confirm documentation you need.

 

HEALTH

By sending us your initial deposit you certify you do not have any physical condition that would make traveling unsafe for you or other travelers. It is your responsibility to ensure you have received all appropriate vaccinations and are aware of the risk involved in traveling to high altitudes.

 

GUESTS NEEDING SPECIAL ASSISTANCE

Certain itineraries may include activities that present challenges that are not suitable for passengers with special needs. We strongly recommend that guests requiring assistance be accompanied by a companion who is capable of, and totally responsible for, providing assistance.

LIMITATION OF LIABILITY, RELEASE AND INDEMNITY

Active Traveler Peru acts as intermediary between clients and carefully selected service providers. We purchase hotel accommodations, transportation, restaurant and other services from various independent suppliers. All such persons and entities are independent contractors independently owned and managed.

The Client by engaging Active Traveler Peru and making full payment for the specified service agrees that Active Traveler Peru cannot be held responsible for delays, damages, accidents, personal injuries, illness, acts of war, strikes or other labor, overbooking or downgrading of services, mechanical or other failure referring to the means of transportation or any activities or circumstances beyond our control and that any refund will be sought directly from the service provider. Moreover it is not liable for any negligent or willful act of any such person or entity or of any third person.

 

PAYMENT

First Payment: 30% deposit by the time of booking 
Second Payment: Full Amount, on your arrival. 
In the case the booking will be proceeded 45 or less days to the arrival, the whole amount will be required in once.

CHANGES & CANCELATIONS

Any cancellations or changes made by the client must be submitted in writing by the client at their earliest convenience 
Client is responsible for any fees or charges incurred by the cancellation.

If the deadline falls on a weekend or holiday, cancellation must be made previously.
The transaction costs will be paid by the client

Refunds will only be paid to you once we have received the funds back from the Supplier(s). We are not responsible for a Supplier’s failure to pay a refund. If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

 

UNUSED SERVICES

There will be no refund made for cancelled or unused services for any reason whatsoever.

AIR/FLIGHT Cancellations: All air packages and air tickets are subject to cancellation policies imposed by the airlines. Generally flight tickets cannot be refunded if they are partially used.

Domestic flights or trains are, occasionally, subject to overbooking, cancellation and schedule changes. If this occurs, we will do everything in our power to assist you in boarding flights or finding alternate arrangements. It must be stressed that this is done as a courtesy to our clients and we cannot be held responsible for denied boarding; neither for the additional costs thus incurred, nor for payments not recovered for missed arrangements due to delays or cancellations.

 

CANCELLATION & CHANGES BY THE TOUR OPERATOR

If a payment tour is cancelled by the Tour Operator before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the Tour Operator:

A.- A substitute Tour of equivalent
B.- A full refund of all monies paid for the cancelled Tour.

The Tour Operator is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, the Tour Operator reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, the Tour Operator will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, the Tour Operator may provide you with a refund for unused products or services as determined in its discretion.

Where after departure a significant element of the trip contracted for cannot be provided, the Company will make suitable alternative arrangements for the continuation of the trip. If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, the Company will provide the Client a refund of unused tour portions. Significant alterations do not include the substitution of a transport, modification of itineraries or time of the services , change in hotel accommodation provided it is of the same category.

 

PRICES

All prices shown on this web site are per person and expressed in US Dollars. 
Once we receive your deposit, your tour package price is guaranteed and any subsequent price increases will be at our expense

Our prices do not include Peruvian Sales Tax ( VAT ) on hotels which applies to Peruvians and foreign residents. Visitors to Peru, who have stayed longer than 60 calendar days, are no longer exempt from the VAT. In order to be exempt from Peruvian sales, you must show appropriate documentation ( nonPeruvian Passport with date of entry and Andean immigration card ).

 

OPTIONAL EXTRAS

“Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the Tour itinerary or price of the Tour and do not form part of the Tour. You agree that any assistance given by the Tour Operator’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and the Tour Operator makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of the Tour Operator regarding any Optional Extras. You release the Tour Operator from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.

You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.

 

ACCOMMODATIONS

The accommodations are specified in the accommodation section of our website 
All prices shown for accommodations are expressed in US dollars and per person 
We reserve the right to offer an alternative accommodation of a similar standard in the case the accommodation is overbooked or for any reason beyond our control.

No changes will be made after payment.

 

Important note: All accommodations within Peru will require you to show your passport and let them make a photocopy of it in order to check you in. This is a requirement for government and taxes purposes.

 

CLAIMS AND COMPLAINTS

If a client has a complaint against the company the client must first inform the tour conductor, guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 5 days of the end of the tour.

Venue for all claims or disputes shall be exclusively in Cusco, Peru, whose courts, using Peruvian Law, shall have exclusive jurisdiction.

 

GOVERNANCE

VOLUNTOURISM TERMS & CONDITIONS

CONTRACT

The volunteer program is accepted when Active Traveler Peru receives the first deposit from its clients. At this point in time the contract between client and Active Traveler Peru is effective and legally binding.

PASSPORT, VISA, ANDEAN MIGRATION CARD AND VACCINATIONS

It is the sole responsibility of the customer to have in their possession a valid passport, visa permits, vaccination certificates and preventative medications as required for the duration of their trip. Active Traveler Peru accepts no liability for customers who travel without the required documentation and medication.

 

INSURANCE

We recommend that volunteers obtain their own health insurance and travel insurance before leaving your home country. Active Traveler Peru does not cover any type of insurance or medical fees.

Accordingly, the volunteer is solely responsible for deciding the type, extent, and level of any insurance they require during the planned travel period and is solely responsible for organizing and covering the costs of this insurance.

 

AIRPORT PICK UP

Active Traveler Peru provides airport pick-up for a volunteer that books accommodation with Active Traveler Peru. The airport pick-up will be provided from the airport in Cusco: Alejandro Velasco Astete International airport.  
The volunteer is obliged to inform Active Traveler Peru of the details of the flight of arrival to Cusco at least 5 days in advance. Active Traveler Peru will not be able to arrange the airport pickup, if a student sends incomplete information or sends the information too late or if there are last-minute changes.

 

RESPONSIBILITIES AND OBIGATIONS FOR THE VOLUNTEER

  • A volunteer is 18 years or older
  • The volunteer is responsible for the possession of the correct travel documents, tickets and insurances.
  • The volunteer is responsible for additional costs of excursions, leisure, etc.
  • The volunteer is responsible for transportation from home to the project and vice versa.
  • The volunteer faces the other culture with an open mind, does not condemn, respects and adapts to the culture where possible.
  • The volunteer respects and keeps to the rules of the organization.
  • The volunteer respects and keeps to the rules of the host family:
    • Respect the accommodation and the housemates
    • Communicate with the family when you are ill and can`t go to work
    • Communicate with the family when you are travelling or don`t spend the night in the house
    • Ask for permission before inviting guests to the house, guests never stay the night
    • In the house of the host family, smoking is prohibited.
    • Pets are not allowed

 

PERSONAL RISKS

The volunteer acknowledges and accepts the responsibilities and risks associated with their choice to travel to, temporarily reside in, and provide volunteer services in a foreign country. Such travel and volunteer work can be hazardous and involves a certain degree of risk, inherently dangerous activities and personal perils to the volunteer, both foreseen and unforeseen, all of which are fully accepted by and solely assumed by the volunteer. Therefore, Active Traveler Peru, including any and all of its employees, managers, directors, shareholders, host families and independent local teams, is not liable, to the maximum extent of the law, for any loss or harm the volunteer or associates may suffer, including but not limited to loss caused directly or indirectly by:
  • Personal injury
  • Emotional injury
  • Death
  • Illness or disease
  • Damage to or loss of property
  • Natural disasters
  • Hostage situations
  • War or terrorism

Anyone who suffers from an illness or disability or is being treated for any physical or medical condition must declare the nature of such conditions at the time of booking. Failure to disclose these conditions will be deemed as a breach of our terms and conditions and result in booking cancellation and no refunds being applicable.

 

UNEXPECTED CIRCUMSTANCES

Unexpected circumstances are: local unrest, war, blocking of transport, strikes, fire, and flood. Where in the case of unexpected circumstances the program has to be cancelled or postponed Active Traveler Peru will make every effort to deal this the correct way, without obligations to complete compensation.

In case of unexpected difficulties between the volunteer and the host family or the project, Active Traveler Peru will do everything we can to find another host family and/or project for the volunteer. Volunteers can only request housing changes in their first 3 days. If the volunteer fails to submit the pre-made rules, standards and guidelines applying to participate in the program, Active Traveler Peru reserves the rights to end the program immediately without any refund of fees.

REFUNDS

Once the program commences, there shall be no refunds, either full or partial, for any reason.

 

CANCELLATION & MODIFICATION BY ACTIVE TRAVELER PERU

Active Traveler Peru reserves the right to cancel or modify any program due to circumstances that make it impossible to complete with the students program or to guarantee the safety of our staff or the safety of the student (like war, natural disasters and strikes).
 The agreement is dissolved by notice of cancellation. Active Traveler Peru will offer an alternative course similar to the cancelled course for the same price. If this offer is not accepted, then Active Traveler Peru will return the total payment received by Active Travler Peru (total payment minus costs for international money transfer).
Active Traveler Peru is not responsible for delays or cancellations of flights or from any other means of transport that influence the further program of a student. A student arriving after the beginning of a program will not be refunded for any unused portion.

 

LIABILITY

Active Traveler Peru cannot be held liable for any damage, delay, loss or injury during the program of Volunteering-Peru. Active Traveler Peru attaches importance to the safety off the volunteer during the program. Despite the careful and competent actions of our coordinators, there is always a risk of incidents. The volunteer must at all time think about his own safety and act responsible. The volunteer shall bear the risks associated with traveling abroad.

Our organization is not responsible for problems or consequences that may occur as a result of breaking the laws of Peru.

 

ACTIVE TRAVELER PERU ACTS AS INTERMEDIARY

You understand that ‘Active Traveler Peru is a local tour operator that provides a service connecting volunteers to partner organizations.  You agree that Active Traveler Peru is not liable for any actions or omissions of any partner organization.

You accept, understand and acknowledge that we organize, promote and offer programs that offer accommodation, transportation and other services provided by our suppliers, which are independent and separate entities from Active Traveler Peru, and over which we have no authority or oversight.

 

PRIVACY

Active Traveler Peru does not sell your personal information to third parties.
By agreeing to the terms and conditions you agree that Active Traveler Peru can use your photos and written feedback while at the project to post on its website www.activetravelerperu.com or posted on our Facebook page and other social media network sites and is not responsible for a claims arising towards that material/photos/content.

Active Traveler Peru may occasionally send news, such as information on our current events, special events happening during your stay, promotions etc. to your provided email address.

 

GOVERNANCE
